By accessing and using this platform, you indicate your acceptance of these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, please refrain from using this platform!
GetaDoc (“GetaDoc”) reserves the right to modify and update these Terms and Conditions at any time. Continued use of the GetaDoc website (“GetaDoc Platform,” or the “Platform”) implies your acceptance of any such changes.
The Platform Does Not Offer Medical Advice
The contents of the GetaDoc Platform, including text, graphics, images, and other materials created by GetaDoc or obtained from GetaDoc’s licensors, as well as other materials present on the GetaDoc Platform (collectively, “Content”), are intended solely for informational purposes. The Content should not be considered a substitute for professional medical advice, diagnosis, or treatment. Always consult your healthcare professional or another qualified health provider for questions regarding a medical condition. Do not disregard professional medical advice or delay seeking it based on information from the GetaDoc Platform!
In case of a medical emergency, contact your physician or call 911 immediately. GetaDoc does not endorse or recommend specific tests, physicians, products, procedures, opinions, or other information presented on the Platform. Reliance on information provided by GetaDoc, its employees, individuals invited by GetaDoc to appear on the Platform, or other visitors to the Platform is solely at your own risk.
Privacy of Children
We are committed to safeguarding children’s privacy. It is important to note that the GetaDoc Platform is not designed for or targeted at children under the age of 13. We do not intentionally collect personally identifiable information from individuals we know to be under 13 years of age.
Use of Content
The Content posted on this Platform is protected by copyright laws in South Africa and other countries. GetaDoc grants you permission to view or download a single copy of the Content strictly for your personal, noncommercial use, provided you include the copyright notice located at the end of the material, such as: “©2023, GetaDoc. All rights reserved,” and other copyright and proprietary rights notices contained in the Content. Specific guidelines for using particular software and other items accessible on the GetaDoc Platform may be available elsewhere on the Platform and are considered a part of these Terms and Conditions.
Ownership of the Content remains with GetaDoc or its licensors. Any unauthorized use of the Content, not expressly allowed by these Terms and Conditions, constitutes a breach and may infringe copyright, trademark, and other laws. Content and other features may be altered or terminated without notice, at GetaDoc’s editorial discretion. All rights not explicitly granted herein are reserved by GetaDoc and its licensors.
Liability of GetaDoc and Its Licensors
Use of the GetaDoc Platform and Content is at your own risk.
When utilizing the GetaDoc Platform, data or information may be transmitted over networks beyond GetaDoc’s control. Consequently, GetaDoc assumes no liability for delays, failures, interruptions, or corruption of data or information transmitted during Platform use.
The GetaDoc Platform and Content are provided “as is.” TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GETADOC, ITS LICENSORS, AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, AND FITNESS FOR A PARTICULAR PURPOSE. This includes, but is not limited to, the following:
- The accuracy, reliability, completeness, timeliness, or currentness of Content, software, links, or communications provided on or through the GetaDoc Platform.
- Compliance with government regulations requiring the disclosure of prescription drug information or approval/compliance of software tools regarding Content on the GetaDoc Platform.
Under no circumstances shall GetaDoc, its licensors, its suppliers, or any third parties mentioned on the GetaDoc Platform be liable for any damages (including incidental and consequential damages, personal injury/wrongful death, lost profits, or damages from lost data or business interruption) arising from the use or inability to use the GetaDoc Platform or Content, whether based on warranty, contract, tort, or other legal theory, regardless of whether GetaDoc, its licensors, its suppliers, or any third parties mentioned on the GetaDoc Platform were aware of the possibility of such damages. GetaDoc, its licensors, its suppliers, or any third parties mentioned on the GetaDoc Platform shall be liable solely for actual damages incurred by you, not exceeding the equivalent of ZAR 10,000. GetaDoc, its licensors, its suppliers, or any third parties mentioned on the GetaDoc Platform are not responsible for personal injuries, including death, caused by your use or misuse of the Platform, Content, or any Public Areas (as defined below). Claims related to Platform use, Content, or Public Areas must be initiated within one (1) year of the event giving rise to such claim. Remedies under these Terms and Conditions are exclusive and limited to those explicitly provided in these Terms and Conditions.
User Content and Submissions
Any personal information you submit to GetaDoc is governed by the GetaDoc Privacy Policy. In case of any inconsistency between this Agreement and the GetaDoc Privacy Policy, this Agreement takes precedence.
The Platform encompasses interactive areas, including blogs, user reviews of medical information, and user reviews on the Medical Practitioner Directory (collectively “Public Areas”), allowing users to post or upload content and information, including comments, images, questions, reviews, and other materials (“User Content”). Users can also upload User Content via GetaDoc’s official presence on social media platforms and branded hashtags, such as Facebook, Twitter, Google Plus, YouTube, Instagram, and Pinterest (collectively “Social Media Platforms”). By posting User Content in Public Areas or Social Media Platforms, you agree to adhere to these Terms and Conditions and other applicable policies, such as our Review Guidelines. GetaDoc reserves the right to remove User Content, including User Content that we believe violates these Terms and Conditions or other policies, like our Review Guidelines. Your submission of User Content or communications to Public Areas or Social Media Platforms is non-confidential for all intents and purposes. GetaDoc is not responsible for the operations, terms of use, or policies of any Social Media Platform. Review the terms of use and policies, including privacy policies, of any Social Media Platform you use.
By submitting User Content or communications to Public Areas or Social Media Platforms, you grant or warrant that the owner of the content or intellectual property has explicitly granted GetaDoc a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, fully sublicensable right and license to use, reproduce, create derivative works from, modify, adapt, publish, edit, translate, distribute, perform, and publicly display such User Content. GetaDoc may sublicense its rights through multiple tiers of sublicenses. To maintain the privacy of business information, ideas, concepts, or inventions, do not submit them to Public Areas, Social Media Platforms, or GetaDoc via email. While we aim to respond to emails promptly, volume might hinder our ability to do so.
User Submissions — Image, Video, Audio Files
You agree to post or upload only media (e.g., photos, videos, audio) on the GetaDoc Platform or a Social Media Platform that you have personally created or for which you possess all necessary rights to transmit and license, while adhering to trademark, copyright, privacy, and other rights of any other individual. Images or videos of celebrities, cartoons, or comic images are typically copyrighted by the owner.
To safeguard privacy, you agree not to submit media containing Personally Identifiable Information (e.g., name, phone number, email address, or website URL) of yourself or others. Uploading media featuring images or videos of other people without their explicit consent is strictly prohibited.
Upon uploading any media on the GetaDoc Platform or a Social Media Platform, you affirm that all individuals depicted in the media have given you permission to make this contribution and grant the rights described herein. Posting a picture or video of someone else, or with someone else, requires their explicit permission.
Uploading any media that includes expressions of hate, abuse, offensive images or behavior, obscenity, pornography, sexually explicit material, or content that may lead to civil or criminal liability under relevant laws or regulations or conflict with these Terms and Conditions, the GetaDoc Advertising Policy, or the GetaDoc Privacy Policy, is prohibited.
You acknowledge that you will not upload any materials containing software viruses or any other computer code, files, or programs designed to interrupt, damage, or restrict the functionality of any computer software or the GetaDoc website.
By uploading any media on the GetaDoc Platform or a Social Media Platform, such as a photo or video: (a) you grant GetaDoc a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully sublicensable right and license to use, copy, print, publicly display, reproduce, modify, publish, post, transmit, create derivative works from, and distribute the media and any content within the media; (b) you affirm that any individuals depicted in the submitted media (or, if a minor, their parent/legal guardian) grant GetaDoc the right to use, copy, print, publicly display, reproduce, modify, publish, post, transmit, create derivative works from, and distribute the media and any content within such media; and (c) you agree to indemnify GetaDoc, its affiliates, directors, officers, and employees and hold them harmless from any claims and expenses, including legal fees, arising from the media and/or your failure to comply with these Terms and Conditions.
GetaDoc reserves the right to review all media before submission to the Platform and remove any media for any reason, at any time, without prior notice, at its sole discretion.
Passwords
Several tools on GetaDoc allow you to record and store information. You are responsible for taking reasonable measures to prevent unauthorized access to your GetaDoc passwords or accounts. It is your sole responsibility to: (1) control the distribution and use of sign-in name, screen name, and passwords; (2) authorize, supervise, and manage access to and use of your GetaDoc account and password; (3) promptly notify GetaDoc of any compromised account or password. For email communication, utilize the “Contact Us” links situated at the bottom of every page on our Platform. You provide GetaDoc and all other involved parties the right to transmit, monitor, retrieve, store, and use your information for Platform operations. GetaDoc is not liable for information submitted or misuse of information transmitted or received through GetaDoc tools and services.
User Content Guidelines
When using or posting User Content in Public Areas, such as blogs, or on Social Media Platforms, you are solely responsible for your own communications, the consequences of your posts, and your reliance on any communications within Public Areas or on Social Media Platforms. GetaDoc and its licensors bear no responsibility for outcomes arising from any communications in Public Areas or on Social Media Platforms. If you suspect danger or feel threatened, contact your local law enforcement agency immediately. For medical emergencies, contact your doctor or 911 immediately.
By utilizing the Public Areas and Social Media Platforms, you acknowledge that the following actions are considered material breaches of these Terms and Conditions:
- Using Public Areas or Social Media Platforms in violation of local, state, national, or international laws;
- Posting content infringing on intellectual property rights, privacy, or publicity rights of others;
- Posting unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing content that GetaDoc deems inappropriate;
- Posting advertisements or business solicitations;
- Continuing to disrupt normal dialogue after a warning or posting unrelated comments (unless clear that discussion is open);
- Posting chain letters or pyramid schemes;
- Impersonating another person;
- Disseminating viruses or other harmful code;
- Collecting information about others, including email addresses, without proper identification for posting or viewing comments;
- Permitting others to use your identification for posting or viewing comments;
- Posting the same content repeatedly or “spamming”;
- Engaging in actions inhibiting or restricting others’ enjoyment or use of Public Areas, Social Media Platforms, or the Platform, or which, according to GetaDoc’s judgment, exposes GetaDoc, its customers, or suppliers to liability or harm of any kind.
GetaDoc Reserves the Right (but is Not Obligated) to Do Any or All of the Following:
- Record dialogue in public chat rooms;
- Investigate claims that communications do not conform to the terms of this section and decide, at its sole discretion, to remove or request removal of such communications;
- Remove communications that are abusive, disruptive, or illegal, or fail to adhere to these Terms and Conditions;
- Terminate a user’s access to Public Areas, Social Media Platforms, and/or the GetaDoc Platform upon any breach of these Terms and Conditions;
- Monitor, edit, or disclose communications in Public Areas or on Social Media Platforms;
- Edit or delete posted communications, regardless of whether they violate these standards.
- GetaDoc or its licensors hold no liability or responsibility toward users of the GetaDoc Platform or any other individual or entity for the execution or non-execution of the activities mentioned above.
Advertisements, Searches, and Links to Other Sites
GetaDoc might provide links to third-party websites and prioritize certain sites as responses to your search queries, possibly featuring advertisements or sponsored content in response to specific search terms. GetaDoc does not recommend or endorse content on third-party websites. GetaDoc is not accountable for content on linked third-party sites, sites framed within the GetaDoc Platform, third-party sites in search results, or third-party advertisements, and makes no claims regarding the content’s accuracy or validity. Use of third-party websites is at your own risk, subject to those sites’ terms and conditions. GetaDoc does not endorse any product, service, or treatment advertised on the GetaDoc Platform. Indemnification
You agree to indemnify and hold harmless GetaDoc, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including reasonable legal and accounting fees, arising from or alleged to arise from: (a) your use of the Platform, (b) any User Content you post or upload, (c) your use of or reliance on any User Content, or (d) your violation of these Terms and Conditions.
General
GetaDoc is headquartered in South Africa, and these Terms and Conditions are governed by the laws of South Africa. The Platform and Content access may not be legal in certain jurisdictions or for certain individuals. Use of the GetaDoc Platform from outside South Africa is at your own risk, and you are responsible for compliance with your local laws.
The following provisions persist beyond the expiration or termination of this Agreement for any reason: Liability, User Submissions, User Submissions – image, video, audio files, Indemnity, Jurisdiction, and Complete Agreement.
Jurisdiction
You expressly agree that exclusive jurisdiction for any dispute with GetaDoc or related to your use of the GetaDoc Platform is vested in the courts of South Africa. You further consent to personal jurisdiction in the courts of South Africa in connection with any dispute, including any claim involving GetaDoc or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.
These Terms and Conditions are governed by the internal substantive laws of South Africa, without regard to conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by a court with competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
Notice and Takedown Procedures; and Copyright Agent
If you believe that any accessible materials on the Platform infringe on your copyright, you may request removal of such materials (or access thereto) by contacting GetaDoc’s copyright agent (provided below) and furnishing the following information:
- Identification of the copyrighted work believed to be infringed, including description and location (e.g., URL) of an authorized version.
- Identification of the infringing material and its location. Describe the material and provide its URL or any relevant information to locate it.
- Your name, address, telephone number, and (if available) email address.
- Statement that you have a good faith belief that the use of materials is not authorized by the copyright owner, its agent, or the law.
- Statement that the information provided is accurate, and affirmation that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature or equivalent electronic authorization from the copyright holder or authorized representative.

To protect copyright holders’ rights, GetaDoc enforces a policy to terminate, in appropriate circumstances, subscribers and account holders of the Platform found to be repeat infringers.
Complete Agreement
With the exception of specific “legal notices” on the GetaDoc Platform, these Terms and Conditions and the GetaDoc Privacy Policy constitute the complete agreement between you and GetaDoc regarding the Platform’s use and content.
We appreciate your cooperation. We trust that you find the GetaDoc Platform beneficial and user-friendly.
